Rules and Regulations.

 

GENERAL POLICIES AND PROCEDURES

A. The Club shall have the unqualified right to make such rules, regulations and restrictions in the use of the Club property as it may deem necessary.

B. All signs posted in the Club shall be considered as part of the rules and regulations.

C. No member of the Club shall advertise or permit his membership to be advertised for sale. Memberships are non-transferable, non-assignable and non-voting.
D. Membership cards are issued to members only and are not to be used by friends or relatives. Infraction of this rule will result in immediate expulsion from the Club. The membership card is Club property, the possession of which may be determined at the Club’s discretion.

E. Charges and fees for services and facilities are subject to change as deemed necessary by the Club.

F. No refunds shall be made for membership dues paid, except as follows:

1. If the member moves further than 50 miles from Club; prepaid sum which is allocable to services he has not received shall be refunded in a timely manner.

2. If the member dies or is permanently disabled, and is therefore unable to receive all services for which he/she has contracted, he/she and his estate shall be relieved from the obligation of making payments for services other than those received prior to death or onset of disability, and if he/she has prepaid any sums for services, so much of such sum as is allocable to service he/she has not received shall be promptly refunded to him or his representative. As used herein, the term “disability” means a condition which precludes the member from physically using the facilities, and such condition is verified by a physician, and “permanent” means for more than six months. No refunds will be given for temporary disability. Rather, if a member becomes disabled for a period of six months or less, the term of his membership agreement will be extended by the duration of the disability. During the term of such disability, the member will not be required to pay dues or incur a new registration fee; neither will he/she be entitled to receive services.

G. Any member who is loud, offensive, and bothersome to the other members or employees or behaves otherwise in an unbecoming manner or who is cited for infraction of rules and regulations may be suspended or expelled from the Club. In the event of termination, the unused portion of any advanced payment shall be forfeited to the Club.

H. In the event that a member becomes temporarily disabled and, therefore, is not able to use the services and facilities of the Club, the membership term will be extended for a period equal to the length of the temporary disability and verified by a physician.

I. Hours of operation are posted at the Club and are subject to change as Club utilization dictates.

J. There will be NO SMOKING permitted on the Club premises.

K. All members and guests must sign in at the reception desk upon entering the Club.

L. Members must display membership cards every time they enter the Club. Members are required to show photo ID with their copy of membership agreement until they receive their membership cards. Members will not be allowed entry to Club without membership cards.

M. The Club is not responsible for Lost and Found items. Items found are immediately placed in public lost and found locations.

N. Any notice required or permitted to be given to you shall be considered duly given when personally delivered to you or mailed to your address as it appears on you membership agreement. Any notice required or permitted to be given by you to the Club shall be considered duly given only when received by the membership office of the Club.

O. No solicitation allowed in club or parking lot.

P. No person under the age of 15 is allowed to use the fitness equipment unaccompanied by a guardian (treadmills, exercise bikes, weight room equipment, ect). Children between the age of 12-15 can use equip if accompanied by a guardian.

Q. Any age child can participate in a J.E.T. based, employee ran program. If guardians decide to leave the fitness center, we must have a contact for the child and guardians must be present within 10 minutes of the end time of said program.

R. Members/Guests are not allowed to leave children (under 15 yrs.) at the club. JET Fitness Center is not a day-care facility.

S. If members do not pick up after themselves there may be a $20 clean up fee charged to the member.

 

II. HEALTH CLUB/FITNESS CENTER

A. Members must wear shirts (covering the chest and back) at all times in the club.

B. Foot covering (i.e., tennis or aerobic shoes) must be worn at all times in all exercise areas, as well as in the entire club. Sock and sandals are not allowed.

C. Members must be properly attired in standard workout clothes (i.e., leotards, gym shorts, jogging suits) while in the exercise areas.

D. Please be aware of circuit rules. Do not cut in on the circuit or do sets if others are waiting.

E. Profanity is not allowed in the gym.

F. Members shall not yell or scream across the gym.

G. Use of the equipment should be instructed by Program Directors.

H. Return weights to proper racks when finished.

I. Have a spotter when using heavy weights.

J. No littering or leaving debris on the gym floor.

K. All members are required to use cleaner and paper towels when finished using equipment.

L. No dropping the weights.

M. Use of hair dyes the Club is strictly forbidden.

N. Please do not eat or drink anything except water in any area of Club.

O. Belongings may not be left in daily lockers overnight. Locks will be cut off and contents removed. The Club does not accept responsibility for items removed from lockers.

P. Chalk is not allowed in gym.

 

III. GUESTS

A. No member shall bring in any individual to perform personal training services.

B. All guests must register upon entering the club.

C. All guests must execute a Waiver and Release of Liability and Indemnity Agreement.

D. Former members and members restricted from the Club may not enter as guests.

E. Out-of-town guests will be charged guest fees.

F. The Club reserves the right to refuse anyone who is not properly attired and/or personally clean.

G. Any guest found in the Club who has not paid the guest fee will be charged double and will no longer be able to use the Club. Members are responsible for their guests. (See Membership Agreement V.)

H. All guests must abide by Club rules and regulations.

 

IV. FEES

A. Guests of members, see desk.

B. Lost items: Membership card replacement $4.00

C. Personal Coaching Programs: please inquire from Program Directors.

D. Enrollment Feels: $5 for student and senior memberships. $30 for Single Gym Options, $40 for Joint options, $45 for family options, $50 for small group training.

E. Annual Fee: $29/year on April 15 of each year for each active membership.

 

Cancellation

JET Fitness Center reserved the right to cancel or terminate membership at any time for any reason without notice. In order to cancel your month to month services or membership with Johnson's Elite Training you must complete the online cancellation form at www.getjetstrong.com/cancel.  It will need to be made 30 days prior to the date you would like your services or membership to be cancelled.12-month/long-term memberships:

1.  Your 12-month membership is not subject to cancellations unless you follow the early termination procedure for your given membership.

Gym Memberships:

Early Termination Fee of $189

30 Day Cancellation form submitted

Personal Training/All-Access:

50% of remaining balance

30 Day Cancellation form submitted

Membership privileges will be disabled once payment arrangements are made

 

THE 30 DAY CANCELLATION NOTICE PERIOD WILL BEGIN UPON RECEIPT OF ALL REQUIRED DOCUMENTATION AND YOUR MEMBERSHIP WILL BE CANCELLED AT THE END OF THE 30 DAYS.  ANY MONTHLY PAYMENTS THAT FALL WITHIN THE 30 DAY NOTICE PERIOD MUST BE PAID BEFORE MEMBERSHIP WILL BE CANCELLED.

Before a cancellation is approved, the JET Fitness Center accounting office must be satisfied that:

1.  All information provided in support of your cancellation request is true and accurate.

2.  All fees are paid current to the effective cancellation date or payment arrangements have been made.

3.  All membership cards have been returned to JET Fitness Center.The burden of proof rests with the member.  

 

JET Fitness Center reserves the right to deny cancellation in the absence of appropriate documentation or non-compliance with this cancellation policy.We hope you'll come back to the JET family at a later time and would love your feedback on why you're canceling!

 

Membership Freeze Policy:

JET Fitness Center will allow you to freeze your month to month or 12-month contract for up to however long you need.  There will be a $10.00 monthly freeze charge.  In order to freeze your services or membership with Johnson's Elite Training a written or emailed notice to cancel@getjetstrong.com will need to be made 15 days prior to the date you would like your services or membership to be cancelled.  The remaining months on your membership will resume after the freeze is lifted from your account.

 

Renewal Policy: JET Fitness Center reserves the right to adjust the monthly or yearly dues upon 30 days written notice.  

Automatic Renewal:

Notice- Please take note that, subject to the preceding paragraph, your membership will automatically renew under existing terms upon expiration absent of 30 day cancellation‍‍‍ notice - www.getjetstrong.com/cancel.

 

V. WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

You (Buyer, each member and all guests and parents signing on behalf of any child under 18) agree that if you engage in any physical exercise or activity or use any Club facility on the premises, you do so at your own risk and assume the risk of any and all injury and/or damage while engaging in any physical exercise or activity or use of any club facility on the premises. Your assumption of risk includes, without limitation, your use of any exercise equipment (mechanical or otherwise), the locker room, sidewalk, parking lot, stairs or tanning bed. Member agrees to assume the risk in his or her participation in any activity, class, program, instruction, or Club-sponsored event. You agree that you are voluntarily participating in the aforementioned activities and using the Club facilities and premises and assume all risk or injury, illness, damage, or loss to you or your property that might result, including, without limitation, any loss or theft of any personal property. You agree on behalf of yourself (and all your personal representatives, heirs, executors, administrators, agents, and assigns) to release and discharge Club (and our affiliates, employees, agents, representatives, successors, and assigns) from any and all claims or causes of action (known or unknown) arising out of the negligence of Club, whether active or passive, or any of its affiliates, employees, agents, representatives, successors, and assigns. This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) your use of any exercise equipment or facilities which may malfunction or break, (b) Club’s improper maintenance of any exercise equipment or facilities, (c) Club’s negligent instruction or supervision, including personal training, or any other form of negligence by the Club or any employee of the Club; and (d) you slipping an falling while on the facility or any portion of the premises for any reason, including Club’s negligent inspection or maintenance of its facility. You also agree to waive any rights that you may have to commence an action or recover damages for any injury at the Club facility to any minor child who is a guest or member. By execution of this agreement, you hereby agree to indemnify and hold harmless Club from any loss, liability, damage, or cost Club may incur due to your presence at the Club facility. You further expressly agree that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the law in the State of Idaho and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

 

YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY, AN EXPRESS ASSUMPTION OF RISK AND INDEMNTIY AGREEMENT. YOU ARE AWARE AND AGREE THAT BY EXECUTING THIS WAIVER AND RELEASE, YOU ARE GIVING UP YOUR RIGHT TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST THE CLUB FOR ITS NEGLIGENCE, OR FOR ANY DEFECTIVE PRODUCT ON ITS PREMISES. YOU HAVE READ AND VOLUNTARILY SIGNED THE WAIVER AND RELEASE AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENT APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE.

 

VI. SEVERABILITY

These provisions of this contract are severable and if any provision is determined to be illegal or unenforceable, the remaining provisions and any partially enforceable provisions shall nevertheless be enforceable. The Club’s failure to enforce any remedy or provision in this contract shall not be construed as a waiver of such remedy or provision.VII. GOVERNING LAWThis agreement shall be construed in accordance with the laws of the State of Iowa with jurisdiction and venue deemed proper in applicable counties in which Club is located.VIII. WAIVER OF JURY TRIALTo the extent permitted by law, member waives any and all rights to a jury trial.

 

IX. INTEGRATION-ENTIRE AGREEMENTThis agreement constitutes the entire and exclusive agreement between the parties and cancels and supersedes prior promises, representations, understandings and/or agreements between the parties. This agreement may be modified only by an instrument in writing signed by all parties; however, the Club or any assignees of this agreement are authorized to correct patent errors in the agreement (and other related documents.)
